Puberty marks the beginning of many obligatory and situational religious rulings. Therefore, finding the correct criterion for the commencement of this divine responsibility is necessary and essential. The majority of Shi&rsquo;a jurists, by establishing a specific age as the criterion, consider boys at fifteen and girls at nine years of age to be religiously accountable and mature (baligh). In contrast, a non-mainstream opinion among jurists holds that puberty is a natural and developmental phenomenon, and its indicators should also be natural and developmental; an arbitrary age cannot be an appropriate indicator for natural puberty. Therefore, to determine the beginning of religious obligation, one must refer to natural indicators&mdash;namely, nocturnal emission (ihtilam) in boys and menstruation (hayd) in girls. This article, through comprehensive examinations of the nature of puberty, the implications of using age as a criterion, and existing social realities, strengthens the second opinion. Based on these findings, a new interpretation of Imam Khomeini&rsquo;s (RA) perspective is presented, which had previously not been given due attention.</p> <p>یکی از مهم&zwnj;ترین دوران زندگی انسان که دگرگونی عظیم جسمی و روحی در او بوجود میآید و با شروع آن انسان مخاطب خاص الهی و مکلف و مسئول اعمالش میشود، بلوغ میباشد. بلوغ آغاز بسیاری از احکام و مقررات تکلیفی و وضعی را مشخص مینماید. بنابراین، یافتن ملاک و معیار صحیح برای شروع این رسالت الهی لازم و ضروری است. مشهور فقهای شیعه با ملاک قراردادن سن مشخص، پسران را در پانزده سالگی و دختران را در نه سالگی مکلف و بالغ می&zwnj;دانند و در مقابل، نظر غیرمشهوری از فقها این گونه است که بلوغ امری طبیعی و تکوینی است و اماره آن هم باید طبیعی و تکوینی باشد و سن اعتباری نمی&zwnj;تواند اماره مناسبی برای بلوغ طبیعی باشد. بنابراین برای تشخیص آغاز تکلیف باید به اماره&zwnj;های طبیعی، یعنی احتلام در پسران و حیض در دختران، رجوع نمود که در این مقاله با توجه به بررسیهای جامع درباره ماهیت بلوغ و آثار و تبعات ملاک قراردادن سن و واقعیات موجود در جامعه نظر دوم تقویت می&zwnj;گردد. بر همین اساس، رهیافتی تازه به نظر امام خمینی(ره)، ارائه شده که پیش از این مورد توجه نبوده است.</p> http://kalam.saminatech.ir/ar/Article/Download/53716
