Couples, through the pattern and assumption of children, play a large role in the tendency of children to worship and spirituality; among couples who have a practical commitment to beliefs and worship, psychological relaxation, inner luminance, and ethical issues, hope, material and spiritual progress And the sense of conscientiousness towards others amongst couples who believe in religious beliefs and worship is very high. Although women are the main pillars of the family and make up half the population of the country, it is less visible that attention to the human rights of women is reflected in the laws, and many of the rights of this group of society are not only women but also as Mother is overlooked. In other words, it can be said that women are deprived of many natural, social and other rights due to being women. The purpose of this article is to examine the role of religious beliefs about the right of custody of women, the right of women to custody in Islamic law and international law and good socialization. For this purpose, the library method has been used. در باور دینی انسان در جهتِ نوعِ هستی، «هستِ» خدایی دارد، از وجود او نشأت گرفته و مقصد نهایی او نیز رسیدن به خداست و هدف از حیات و غایت حرکت او «وصول الی اللّه است؛در متون ديني توصيه‌هاي اخلاقي واعتقادي و عبادي زيادي وجود دارد كه التزام به آنها باعث تقويت و استحكام حسن معاشرت زوجین مي‌شود. زوجین از طريق الگو و اسوه بودن براي فرزندان، نقش زيادي در گرايش فرزندان به عبادت و معنويت دارند، میان زوجینی كه التزام عملي به اعتقادات و عبادات وجود دارد، آرامش رواني، نورانيت دروني و مسايل اخلاقي موج مي‌زند ، اميدواري، پيشرفت مادي و معنوي و همينطور حس وظيفه‌شناسي نسبت به ديگران در میان زوجین معتقد به آموزه‌هاي اعتقادي و عبادي، بسيار بالا است . با این که زنان اصلی ترین رکن خانواده هستند و نیمی از جمعیت کشور را تشکیل می دهند اما کمتر دیده می شود که توجه نسبت به حقوق انسانی زنان در قوانین انعکاس یابد و بسیاری از حقوق این قشر از جامعه نه تنها به عنوان زن بلکه به عنوان مادر نادیده گرفته شده است. به عبارت دیگر می توان گفت زنان به علت زن بودنشان از بسیاری از حقوق طبیعی، اجتماعی و غیره محروم هستند. هدف این مقاله بررسی نقش باورهای دینی در خصوص حق حضانت زنان ، حق حضانت زنان در حقوق اسلام و حقوق بین الملل و حسن معاشرت است. برای این منظور از روش کتابخانه‌ای استفاده شده است http://kalam.saminatech.ir/fa/Article/Download/18770
