"Ijmaa" is one of the sources of ijtihad in jurisprudence and it means a consensus that is effective in proving a ruling. Shia scholars do not consider consensus as an independent proof against the book and Sunnah; Rather, consensus is considered valid only because the discoverer is infallible. This category is considered one of the sources of jurisprudence and has been the focus of the parties. Of course, what is certain is that during the lifetime of the Prophet (PBUH), divine decrees were received through him; Either it was specified in the verses of the Qur'an, or the Prophet (PBUH) himself explained it by words, deeds, or narrations, which is called "Sunnah". Therefore, there was no need for ijtihad and scientific effort to understand the ruling of Sharia; except that they hear from the Prophet (PBUH) personally. In this article, while examining the concept, it deals with the types of consensus and its rulings, and then this issue is analyzed from the perspective of the Shia sect, especially the study of the intellectual system of Abu Talib Harouni, one of the Zaidi scholars, Qazi Noman Ismaili, and Sheikh Tusi, one of the prominent Shia scholars. puts This article is considered new and innovative because so far no article or writing has been devoted to the study of consensus from the perspective of the three scholars of Shiism: Imamiyyah, Zaidiyyah, and Ismailiyyah, and on the other hand, it has been tried to describe the time course and life of all three scholars almost at the same time. be.

واکاوی اجماع از دریچه فرق تشیع

«اِجماع» یکی از منابع اجتهاد در فقه و به معنای اتفاق نظری است که در اثبات حکم شرعی مؤثر است. علماى شیعه اجماع را دلیل مستقلى در مقابل کتاب و سنّت نمی‌دانند؛ بلکه اجماع را تنها از این جهت که کاشف از نظر معصوم است، حجّت می‌دانند. این مقوله یکی از منابع فقه به شمار آمده و مورد توجه فریقین قرار گرفته است. البته آنچه مسلم است، این است که در دوران حیات پیامبر(ص) احکام الهی از طریق آن حضرت دریافت میشد؛ یا در آیات قرآن بدان تصریح شده بود یا شخص پیامبر(ص) با قول یا عمل یا تقریر، آن را تبیین میکردند که اصطلاحاً به آن «سنت» میگویند. بنابراین هیچ نیازی به اجتهاد و تلاش علمی برای فهمیدن حکم شرعی وجود نداشت؛ جز اینکه از شخص پیامبر(ص) بشنوند. در این مقاله ضمن بررسی مفهومشناسی، به اقسام اجماع و احکام آن پرداخته و سپس این مسئله را از دریچه اندیشه‌ای و نه فقهی در فرق تشیع و بهخصوص بررسی منظومه فکری ابوطالب هارونی از عالمان زیدی، قاضی نعمان از اندیشمندان اسماعیلی و شیخ طوسی از علمای برجسته تشیع مورد واکاوی قرار میدهد. این نوشتار از این جهت نو و بدیع به شمار می‌رود که تاکنون مقاله‌ای یا نوشتاری به بررسی اجماع به عنوان یکی از منابع ادله اربعه از منظر سه عالم تشیع در امامیه، زیدیه و اسماعیلیه نپرداخته و از سوی دیگر سعی شده است که سیر زمانی و زیست هر سه عالم تقریبا در یک زمان باشد.
